Please read our terms and conditions carefully before placing your order. It is advisable to print and retain a copy of these terms and conditions along with your order for future reference. The Flickering Cauldron® & Kettle may change these terms and conditions of sale without prior notice.

 

1. Terms of the Contract

These Terms & Conditions of Sale apply to all goods supplied by The Flickering Cauldron® & Kettle; they do not affect your statutory rights.

 

Any order placed by you for goods advertised on our website is considered an offer by you to purchase the goods in your order. No contract exists between you and us until we have received and accepted your order. Once you have placed and paid for your order, you will receive an automated email confirmation. The notification of receipt is not a confirmation of items sent, only that the order has been accepted. You will then receive a despatch confirmation once despatched via email to confirm item has been sent to you.

 

2. Description & Price of Goods

We have taken every care to describe and show all items as accurately as possible, and with accordance to the manufacturer's specification. Despite this, a slight variation in items may occur. We provide you where we can with product information on the website. If there is anything, which you do not understand, or if you wish to obtain further information on a product, please contact the Customer Service Team via email: enquiries@theflickeringcauldron.com

 

Prices on the website are in Pound Sterling and include UK ONLY postage and packaging. We make every effort to keep the prices on our website up to date, however any changes to said prices are subject to change without notice.

 

Every effort is made to ensure the prices shown on the website are accurate at the time of placing an order. If an item has been hugely under-priced in error, we will contact you and offer the following three options:

 

1.Placement of a new order at the correct price of the goods.

 

2.Cancellation of the whole order, with immediate refund.

 

3.Cancellation of your order for the miss-priced goods and reconfirmation of your order for the correctly priced goods.If you do not choose one of the three available options within 3 days, your order will be cancelled. Any payment received from you with respect to the cancelled item(s) will be credited back to your original method of payment.

 

In the unlikely event we discover that your item/s are out of stock, we will email you to inform you of delivery date, if unacceptable we will cancel your order or remove said item/s from your order and any payment received from you with respect to the cancelled item, will be credited back to your original method of payment. We will endeavour to make sure this does not occur but can happen from time to time.

 

3. Payment

No goods will be dispatched until payment has been made in full, and all funds have cleared. If your payment fails, your order will be cancelled. All payments are made through PayPal/Card Clearing Provider and is in GBP (Pound Sterling) which is the accepted payment currency.

 

4. Delivery

Delivery will be made to the address specified through our checkout when you complete your order. Dispatch is 2-3 working days from your order confirmation; this may increase through busy times, but a warning notification will be issued before order confirmation.

 

It is our aim for all orders to be delivered within 3-5 working days of dispatch.

 

Royal Mail Deliveries

UK Postage & Packaging is included in your price and delivery is normally by Royal Mail Track48. If you order has not arrived within 7 days of dispatch, please email us at enquiries@theflickeringcauldron.com, with your order number to let us know, so we can check your order.

 

If your order has not arrived within 17 working days Royal Mail would consider this a failed or lost delivery and we would submit a claim with them while re-sending your goods.

 

If you think your order is late or lost, please check with your local sorting office before contacting us as a large percentage of delayed mail is awaiting collection, without a note or card being left at the household.

 

We cannot do this on your behalf as the sorting office will only tell the addressee whether they have mail waiting and we cannot refund or replace goods until this has been checked.

 

International orders will incur additional postage charges and additional delivery times, The information will be available to before confirming your order.

 

For Courier Deliveries

For all courier deliveries, UK Mainland ONLY Postage & Packaging are included in your price.

 

You will be informed of courier delivery on confirmation of your order, someone will need to be available to receive the delivery between 7.30am and 8.30pm, Monday to Friday. If the couriers are unable to complete a delivery due to nobody being present, or no safe place to leave parcel a calling card will be left asking you to contact them directly to arrange a re-delivery.

 

International orders will incur additional postage charges and additional delivery times, The information will be available to before confirming your order.

 

5.  Right to Cancellation

You have the right to cancel your order with The Flickering Cauldron® & Kettle at any time up to 7 days after receipt of your goods, in line with your statutory rights. 

 

To cancel your order, you must advise us in writing, either by post, by email or by using the Contact Us page of the website.

 

Should you wish to cancel your order after the goods have been dispatched, you will be responsible for returning the goods to us within 17 days, at your own cost, unless the goods are faulty or miss-described. Please follow our returns procedure (see condition 10 below)

 

6. Refund Policy

If you are eligible for a refund, we will refund you back to the method of payment you used when you originally paid your order.

 

The refund amount will be the total amount you have paid for the particular order or arranged amount. Please note: It is your responsibility to advise us of any changes to your PayPal email address.

 

7. Warranty

Any products supplied with a warranty will normally have a 30 day warranty period from the date the goods were delivered (unless otherwise stated and excluding consumables). This warranty does not affect your statutory rights as a consumer.

 

Please note: the warranty does not cover you for any defects in the goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third-party use, otherwise than in accordance with its intended uses.

 

Consumable items (e.g., batteries) are not covered for physical defects in accordance with the terms above. Consumable items (e.g., batteries) are not covered for replacement during 'normal use'

 

8. Faulty Items

If an item is faulty, we may require it to be returned to us for inspection and/or returned to our supplier.  We will cover any postage costs incurred by you should this be the case. We may just ask for photographs, so please do check with us.

 

Please check your order as soon as it arrives, if there are any faults, please let us know as soon as possible.  Even though your consumer rights allow an excessive amount of time for faults, unfortunately with many of our products they go out of stock quite quickly, especially our annual moon diary, we would not be able to replace it for you once this happens.

We do not cover faults caused by your own accident, neglect, misuse or normal wear and tear.

 

When products are returned as faulty, the fault will be verified, and a replacement item will be sent to you within 5 working days at no additional cost to you.

 

If, for any reason, we are unable to replace the faulty item (for example, due to being out of stock or discontinuation), you will be offered a choice of a substitute alternative product or a full refund for the faulty item. If the goods you have returned are found not to be faulty, you will be notified in writing. You will receive a refund or an offer of a replacement for the original goods, however we will ask you to cover the delivery charges, and no return delivery charges will be refunded.

9. Item(s) Damaged on Arrival

All our products are quality inspected before they leave HQ, so they should never leave damaged.  Once dispatched, it is out of our control, and parcels can arrive in a damaged condition, depending on the parcels handling with Royal Mail or the Courier. 

 

Thankfully our packaging is quite strong and secure, so it is a rarity.  If this does happen, please contact us immediately if you can or within 7 days of receipt at the enquiries@theflickeringcauldron.com

 

We will ask for photographic evidence of the damage, with full details for our records and to enable us to make a claim with the Courier or Royal Mail for the damage. 

 

For all accepted damaged items, you will either be sent a new item or given a refund, it is your preference.

 

We do not cover damages caused by your own accident, neglect, and misuse.

 

Most items (excluding silver jewellery) will only require photographic evidence of any visible damage instead of a return. This will be ascertained on an item-to-item basis, and you will be informed on notification.

 

A new item will be sent direct to you if this is the case once the photographic evidence has been accepted.

 

If, for any reason, we are unable to replace the damaged item (for example, due to being out of stock or discontinuation), you will be offered a choice of a substitute alternative product or a full refund for the faulty item.

 

If you are asked to return the damaged goods and the goods are found, not to be damaged, you will be notified in writing. You will receive a refund or an offer of a replacement for the original goods, however we will ask you to cover the delivery charges, and no return delivery charges will be refunded.

 

Please follow out returns procedure (see condition 10 below).

 

10. Returns Procedure

Please note, as stated in condition 8 and 9, in the event of an item being damaged or faulty, contact must be made as per condition to ourselves in writing and we will advise whether a return is necessary.

 

We request photographic evidence of all damages wherever possible.

 

All other returns Items should be returned in their original packaging and 'as new'.

Before returning any items, you must inform us of the reason for the return, quoting your original order number, name, and full address.

 

For faulty or if deemed, damaged items, we will pay for the postage.

 

However, if you wish to return your item, as you ordered by mistake or have changed your mind, you are fully entitled to do so within 14 days of receipt of your order.

 

Please make sure your item is sent back undamaged, (unopen if you can) with original product packaging intact.  You will be responsible for the return postage.

 

For all returns, please make sure you get a receipt of proof of postage or tracking details in the event of an item not arriving back to us, as we will not take responsibility for unreturned packages, lost in transit.

 

Once we receive your parcel back into HQ we will refund you for your parcel value, less the postage & packaging cost, that was incurred sending it to you.

 

Please note, we make no profit of any kind on postage, it is simply just passed on, infact sometimes we cover some of the postage.  However, we will only charge you what the Post Office/Courier has charged, when sending your refund.

 

Your refund can only be paid to the account used in the original purchase.

 

11. Digital Products

All our digital products are not for download and for online viewing only, unless specifically stated otherwise, and are non-refundable.

 

12. Data Protection

The Flickering Cauldron® & Kettle will take all reasonable precautions to keep the details or your order and payment safe and secure. However, unless The Flickering Cauldron® & Kettle is negligent, we will not be liable for unauthorised access to information supplied by you. The Flickering Cauldron® & Kettle does NOT and will NOT supply your details to any third party.

 

13. Images

All though all effort is made to update product images on a regular basis product images are for illustrative purposes and may differ from the actual product. Please note there will be variations in colours pertaining to products.

 

No replacements will be made if a customer is dissatisfied with the colour of a soapstone product as soapstone can vary from any colour between pink and black.

 

If a customer wishes to return a soapstone item due to its colour it should be returned in line with the return's procedure and a refund in full will be given for the original item cost, no refund will be made for postage fees involved.

14. Governing Law & Jurisdiction

These terms of sale and the supply of the goods will be subject to English law and the English courts will have jurisdiction in respect of any dispute arising from the contract.

 

15. Protecting Your Security

All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998.

 

16. Placing An Order

By placing an order with The Flickering Cauldron® & Kettle you are confirming you have read and agree to the terms, conditions and delivery times as laid out in writing on this site. The contract of the sale is bound by the terms laid out in this document.

 

17. Cosmetic Goods

All of our products intended for cosmetic use are certified and tested as required by law, and ingredients for any of these items is available upon request. Our suppliers highly recommends that end users of these products perform a patch test before using any cosmetic product for the first time, and periodically thereafter as allergies can develop from the repeated use of ANY cosmetic product.

 

18. Misuse of Goods
